Payment Terms

Deposit

  • Non-Refundable Deposit: A non-refundable deposit is required to secure any event or date. This deposit will be applied toward the total cost of services.

  • Remaining Balance Due: The full remaining balance is due 14 days prior to the event date. If payment is not received by the due date, Aspen's Garden LLC reserves the right to cancel the booking, and the deposit will be forfeited.

Refund Policy

  • Cancellations made within 14 days of the scheduled event are non-refundable.

  • Cancellations made more than 14 days before the event will receive a refund for any payments made, excluding the non-refundable deposit.

Rescheduling and Cancellation Policy

  • Rescheduling requests must be submitted at least 14 days before the original date to avoid fees.

  • Rescheduling within 14 days of the event date will incur a $150 fee. The new date must be within 6 months, pending availability.

Rental Terms and Conditions

These Terms govern the rental of the Backdrop and other items from Aspen's Garden LLC ("Provider") to the Client and form part of this Agreement.

Setup and Teardown Schedule

  • Setup: Aspen’s Garden LLC will arrive 30 minutes to 1 hour in advance to set up the rented items according to the agreed schedule. For larger events and more elaborate décor, additional time may be required. Our team ensures everything is in place for the Client’s event.

  • Teardown: Teardown will occur within the agreed timeframe after the event. The Client agrees to provide clear and accessible space for Aspen’s Garden LLC staff to complete teardown efficiently.

  • Rental and Compensation: The Client agrees to responsibly oversee all rented items from Aspen's Garden LLC during the rental period, which begins at delivery and ends upon collection by Aspen’s Garden LLC.

Damage and Liability

  • The Client is liable for any damage, loss, or theft of rented items during the rental period.

  • Aspen's Garden LLC will conduct inspections before and after the rental, with the Client present to confirm the item's condition and sign off at both stages.

  • If an item is damaged beyond repair, the Client will be charged the original purchase price plus a loss-of-use fee (20-50% of the purchase price) to cover Aspen’s Garden LLC’s inability to rent the item to future clients.

  • For any damage beyond normal wear and tear, such as tears, stains, or breakage, the Client will be responsible for repair or replacement costs based on the item's original purchase price. Imported floral backdrops range from $600 to $3,000 each, and custom wood bases, crafted by a professional carpenter, range from $300 to $3,000 each.

Liability Waiver and Assumption of Risk

  • Injury and Safety: The Client agrees to ensure the safety of all guests around the rented backdrop. Aspen’s Garden LLC is not liable for any injuries resulting from misuse or mishandling of the items, including but not limited to climbing, leaning, unauthorized relocation, or any other actions that could compromise the stability or safety of the backdrop.

  • A safety inspection will be conducted upon setup, and the Client’s signature will be required to confirm that all items have been safely setup.

  • Waiver: The Client agrees to hold Aspen’s Garden LLC harmless from any claims, damages, or injuries arising from improper use, negligence, or unauthorized actions involving the rented items. This includes any damage or injury resulting from attempts to move, climb on, or otherwise tamper with the backdrop in a manner not intended or approved by Aspen’s Garden LLC.

Use Restrictions

  • Prohibited Uses: Climbing, applying excessive weight, and any misuse of rented items are strictly prohibited. Modifications or alterations to the rented items are not allowed under any circumstances.

  • Emergency Contact: The Client must immediately notify Aspen’s Garden LLC of any issues or concerns regarding the rented items. For assistance, contact Aspen’s Garden LLC at 206-832-7021. For any medical emergencies, please call 911.

Indemnification

  • The Client agrees to indemnify Aspen's Garden LLC against all claims, damages, or expenses, including legal fees, arising from the use or misuse of rented items.

Insurance Coverage

  • Aspen’s Garden LLC carries insurance for its business operations, property, and employees. However, this insurance does not cover rented items while they are in the Client’s possession. Aspen’s Garden LLC does not provide insurance for rental items. The Client is responsible for securing any necessary event insurance. Any loss, theft, or damage to rented items, regardless of cause, remains the Client’s full responsibility, and repair or replacement costs will be charged accordingly.

  • Aspen’s Garden LLC is not liable for any injuries, accidents, or damages resulting from misuse, improper handling, or unauthorized relocation of rented items. Once the items are delivered and set up, the Client assumes all responsibility for their safe and intended use. Any modifications, movement, or use beyond their designed purpose releases Aspen’s Garden LLC from any liability.

Compliance with Laws

  • The Client agrees to comply with all relevant laws and regulations. Aspen's Garden LLC is not responsible for legal issues arising from the Client's use of rented items in violation of any applicable laws.

Additional Terms

  • Reservation and Booking: A booking is confirmed upon receipt of a signed agreement and deposit. Full payment must be completed 14 days prior to the delivery of rented items.

  • Changes to Agreement: Any changes to this agreement must be documented in writing and agreed upon by both parties.

  • Force Majeure: Aspen’s Garden LLC is not liable for non-performance due to events beyond its control, such as natural disasters, pandemics, or acts of war.

  • Governing Law: This agreement is governed by the laws of Washington State. However, if Aspen’s Garden LLC conducts business in a different state for the Client's event, any disputes will be resolved within the jurisdiction of that respective state.

  • Privacy: Aspen’s Garden LLC respects the Client's privacy, using personal information solely for managing the rental and will not share it with third parties.

Social Media and Marketing

  • Client Consent: The Client grants Aspen’s Garden LLC permission to photograph or film the rented items for marketing. Images may be used on social media, the company website, and in marketing materials.

  • Privacy Option: If the Client prefers privacy, they must inform Aspen's Garden LLC in writing at least 48 hours before the event.

  • Social Sharing: The Client is welcome to share photos featuring the rented items and is encouraged to tag Aspen's Garden LLC.

Disclaimer

Photo Booth Rentals:

Technology can fail sometimes! In the unlikely event the photo booth is damaged or stops working, we’ll contact our sister booth, Lil-Click, as a replacement.

If Lil-Click is unavailable, Aspen’s Garden will issue a full refund. Rest assured, we will always do our best to deliver, even in the most unfortunate situations.

Acknowledgment of Terms

By proceeding with a booking, the Client acknowledges that they have read, understood, and agree to abide by these Terms and Conditions. It is the Client’s responsibility to review all terms before booking. These terms will also be provided in the rental contract for reference.
